Black Root Global is the trading name under which our products are marketed and supplied.
Where Black Root Global is a trading name rather than the registered legal entity name, the registered legal entity identified above is the contracting supplier.
The information above should be read together with the information displayed on our Website and applicable transaction documentation.
2. ABOUT OUR BUSINESS
Black Root Global supplies machinery, equipment, parts and related products to customers in South Africa.
Products are sourced internationally and imported into South Africa before being received at our fulfilment facility in Sandton, Gauteng.
Our typical fulfilment process is:
International Supplier → International Transit → Durban Port → Customs & Import Processing → South African Inland Transport → Sandton → Local Courier → Customer
The exact route may vary depending on the product, supplier, shipping method and circumstances of a particular order.
3. PLACING AN ORDER
When you place an order through our Website, you are submitting an order to purchase the selected product or products.
An order is subject to successful payment, availability and acceptance by Black Root Global.
We may contact you if:
- information supplied with the order is incomplete or incorrect;
- a product is unavailable;
- a product cannot reasonably be sourced;
- there is an obvious pricing or product-description error;
- additional information is required to fulfil the order; or
- circumstances outside our reasonable control materially affect fulfilment.
If we are unable to fulfil an accepted order, we will notify you and provide any applicable refund or other remedy in accordance with applicable law.
4. PRODUCT INFORMATION
We make reasonable efforts to ensure that product descriptions, photographs, specifications, measurements and other information displayed on our Website are accurate.
Product photographs are provided for illustrative purposes and minor variations may occur, including differences in:
- colour;
- packaging;
- labelling;
- branding;
- accessories; or
- presentation.
Minor, non-material variations resulting from manufacturer or supplier updates do not necessarily constitute a different product.
Where a product supplied materially differs from the product ordered, the matter will be assessed and dealt with in accordance with applicable law.
5. PRICING
All prices displayed on our Website are subject to change.
The price applicable to an accepted order will be the price confirmed at the time of purchase, subject to any obvious pricing error.
If an obvious pricing error occurs, we may contact the customer before fulfilment to correct the error or, where appropriate, cancel the affected order in accordance with applicable law.
A subsequent change in the Website price will not ordinarily affect an order that has already been accepted.
6. ALL-INCLUSIVE PRICING & CUSTOMS
Our advertised prices are intended to provide customers with an all-inclusive price for normal importation into South Africa.
Unless expressly stated otherwise on the relevant product page, quotation or order confirmation, our advertised price includes applicable:
- customs duties;
- import duties;
- customs-related charges;
- import taxes; and
- applicable taxes associated with the normal importation of the product into South Africa.
Customers will not ordinarily be required to make a separate payment to Black Root Global for customs duties or normal import charges in order for their order to proceed through the standard import process.
Black Root Global manages the applicable import and customs process as part of our fulfilment operation.
Although applicable import costs are included in our pricing, customs authorities and other relevant authorities control the customs and import process. The inclusion of these costs in our price does not guarantee a particular customs or port-processing timeframe.
7. INTERNATIONAL SOURCING & FULFILMENT
Products are sourced internationally specifically for customer orders.
The estimated international fulfilment timeframe is:
35–45 BUSINESS DAYS FROM ORDER CONFIRMATION
This estimated timeframe may include:
- international supplier processing;
- preparation of the goods;
- international transportation;
- arrival at Durban Port;
- customs and import processing;
- release from the port; and
- transportation to our Sandton fulfilment facility.
The 35–45 business day period is an estimated international fulfilment timeframe and is not a guaranteed delivery date to the customer's address.
International fulfilment may take longer where there are delays caused by suppliers, shipping schedules, customs, port operations, public holidays, regulatory requirements, weather, logistics disruptions or other circumstances outside our reasonable control.
8. DURBAN PORT & CUSTOMS PROCESSING
International shipments may arrive in South Africa through Durban Port.
Arrival at Durban Port does not mean that an order is immediately available for delivery.
After arrival, goods may be subject to:
- customs inspection;
- import clearance;
- documentation requirements;
- port procedures;
- regulatory requirements;
- customs-related processing; and
- other applicable government or logistics procedures.
The duration of these processes may vary.
A period during which tracking does not update, or an order remains at Durban Port or in customs processing, does not necessarily mean that the shipment has been lost or that fulfilment has stopped.
Where reasonably possible, Black Root Global will investigate significant delays and provide available information to the customer.
9. SANDTON FULFILMENT
After applicable import, customs and inland transportation processes have been completed, the goods are received at our fulfilment facility in Sandton, Gauteng.
Customer orders are then:
- received;
- checked;
- processed; and
- prepared for local dispatch.
The local delivery stage begins once the customer's order has been dispatched from our Sandton facility.
10. LOCAL DELIVERY
Local deliveries are made using our third-party courier partner, The Courier Guy.
Once an order has been dispatched from our Sandton facility, local delivery is generally estimated at:
1–3 BUSINESS DAYS
Actual delivery times may vary depending on:
- destination;
- courier capacity;
- public holidays;
- peak periods;
- weather;
- remote locations;
- incorrect or incomplete delivery information;
- failed delivery attempts; and
- other courier operating conditions.
The 1–3 business day period is an estimate and is not a guaranteed delivery date.
11. LOCAL DELIVERY FEES
Where a local delivery fee is charged at checkout, that fee relates specifically to the local delivery of the order from our Sandton fulfilment facility to the customer's nominated delivery address.
International sourcing, international transportation, Durban Port processing, customs clearance and transportation to our Sandton facility occur before the local delivery stage.
Accordingly, a delay during:
- international sourcing;
- international transportation;
- Durban Port processing;
- customs processing; or
- transportation to Sandton
does not, by itself, constitute a failure of the local delivery service.
Once an order has reached our Sandton facility and has been handed to the local courier, the local delivery stage has commenced.
A delay during an earlier stage of fulfilment does not automatically entitle a customer to a refund, discount or credit of the local delivery fee.
Where a genuine failure occurs during the local delivery stage, or where a refund or other remedy is required under applicable law, the matter will be assessed accordingly.
Black Root Global may, at its discretion, offer a goodwill discount, credit or delivery-fee adjustment in appropriate circumstances.
12. ORDER TRACKING
Customers can track orders placed with Black Root Global through our track your order page
Tracking may be accessed using:
- the Order ID; and
- the email address used when placing the order.
Depending on the stage of the order, tracking information may relate to:
- international sourcing;
- international transportation;
- Durban Port;
- customs processing;
- inland transportation;
- Sandton fulfilment;
- local dispatch; or
- courier delivery.
Once the order has been handed to The Courier Guy, applicable courier tracking information may also be available.
Tracking information is provided for convenience and may not update continuously.
A lack of movement on tracking does not automatically mean that an order has been lost.
13. ORDER CANCELLATION
Customers may request cancellation of an order within:
24 HOURS OF PLACING THE ORDER
provided that the order has not already entered:
- production;
- supplier processing;
- international fulfilment; or
- shipping.
Cancellation requests should be submitted as soon as possible.
Where an order is successfully cancelled within the applicable period and before fulfilment has commenced, any applicable refund will be processed in accordance with our Returns & Refunds Policy and applicable law.
14. CANCELLATION AFTER 24 HOURS
Once an order has entered production, supplier processing, international fulfilment or shipping, cancellation may no longer be operationally possible.
Once the supplier has dispatched the goods, cancellation may no longer be possible.
Where cancellation is no longer operationally possible, the customer may need to follow our applicable Returns & Refunds Policy.
This is particularly relevant where products are sourced internationally specifically in response to a customer's order.
Nothing in this cancellation policy is intended to exclude or restrict any statutory cancellation, cooling-off, return or refund right that applies under South African law.
15. ELECTRONIC TRANSACTIONS & COOLING-OFF RIGHTS
Where applicable, customers retain any statutory rights arising from South African electronic-commerce legislation.
The Electronic Communications and Transactions Act provides a cooling-off right for qualifying electronic transactions, subject to the exceptions contained in the Act.
Our 24-hour cancellation policy is intended to govern our operational order-cancellation process and does not seek to remove a statutory right that cannot legally be excluded.
16. RETURNS & REFUNDS
Returns, refunds and exchanges are handled in accordance with our applicable Returns & Refunds Policy and South African consumer legislation.
Where goods are defective, unsafe, materially different from what was ordered, or otherwise subject to a statutory remedy, the matter will be dealt with in accordance with applicable law.
We may request reasonable information, photographs or video to assist with investigating a return, product issue or damage claim.
Nothing in this requirement limits any statutory consumer right.
17. DAMAGED GOODS
Customers should inspect goods after delivery and notify Black Root Global of visible damage as soon as reasonably possible.
Where possible, customers should provide photographs or video showing:
- the outer packaging;
- shipping label;
- damaged packaging;
- damaged product; and
- the condition of the product when received.
This assists us in investigating the matter with the courier and relevant logistics providers.
Failure to report visible damage immediately does not automatically remove any statutory rights that may apply.
18. INCORRECT OR INCOMPLETE ORDERS
If a customer receives an incorrect, incomplete or apparently missing item, the customer should contact Black Root Global as soon as reasonably possible.
We will investigate the matter against our fulfilment records and, where necessary, with the relevant supplier or courier.
Where an error is attributable to Black Root Global, we will provide an appropriate remedy in accordance with applicable law.
19. LOST SHIPMENTS
If tracking indicates that a shipment may be lost, incorrectly delivered or cannot be located, Black Root Global will investigate the matter with the relevant logistics provider.
Customers should not assume that an order has been lost merely because tracking has not updated for a period of time.
If a shipment is confirmed as lost or cannot reasonably be recovered, the appropriate replacement, refund or other remedy will be assessed in accordance with applicable law.
20. DELIVERY ADDRESS
Customers are responsible for providing accurate delivery information.
This includes:
- full name;
- physical address;
- suburb;
- city;
- postal code; and
- contact details.
Incorrect or incomplete information may result in delays, failed delivery attempts or additional courier charges.
21. FAILED DELIVERY ATTEMPTS
Where delivery cannot be completed because the recipient is unavailable, the address is incorrect or incomplete, access is unavailable, delivery is refused, or another circumstance attributable to the recipient prevents delivery, the courier may arrange a further delivery attempt or provide collection instructions.
Customers should follow the courier's instructions in such circumstances.
22. ONE-YEAR WARRANTY
Unless otherwise stated on the applicable product page or invoice, the machine is supplied with:
A ONE-YEAR BLACK ROOT GLOBAL WARRANTY
The warranty covers manufacturing defects in the machine.
The one-year warranty is an express warranty provided by Black Root Global and operates alongside any statutory rights and remedies available to consumers under South African law.
The warranty does not cover damage or failure caused by circumstances including:
- human error;
- misuse;
- abuse;
- accidental damage;
- incorrect installation;
- incorrect operation;
- failure to follow the supplied instructions;
- improper maintenance;
- unauthorised modification;
- use outside the manufacturer's specified operating conditions;
- normal wear and tear;
- consumable components; or
- damage unrelated to a manufacturing defect.
Nothing in this warranty excludes or limits a statutory consumer right that cannot lawfully be excluded or limited.
ons.
Customers should follow the courier's instructions in such circumstances.
23. WARRANTY CLAIMS
Customers who believe that a machine has developed a manufacturing defect should contact Black Root Global with:
- Order ID;
- customer name;
- description of the problem;
- photographs and/or video where applicable;
- details of how the machine is being used; and
- any other information reasonably required to assess the issue.
We may conduct a warranty assessment before determining the appropriate remedy.
Depending on the circumstances, the issue may be addressed through:
- troubleshooting;
- instructional assistance;
- replacement of a component;
- repair;
- replacement of the product; or
- another applicable remedy.
24. WARRANTY REPLACEMENT PARTS
Where a replacement part is required for a qualifying manufacturing defect covered by the Black Root Global warranty, the replacement part will be supplied in accordance with the applicable warranty.
Warranty replacement parts are not necessarily held locally in South Africa.
Where a required part is not held locally, it may need to be sourced internationally.
Depending on the nature of the part, availability and urgency, the part may be transported by:
- air freight, or
- sea freight.
The transportation method may depend on the size and nature of the part, availability, urgency, shipping schedules, customs requirements and other logistics considerations.
Accordingly, warranty replacement parts may require additional time to reach South Africa.
25. WARRANTY PART DELIVERY OR COLLECTION
Once a warranty replacement part has arrived at our South African facility, customers may:
Local Delivery
Arrange local delivery to their nominated address, subject to any applicable local delivery charge where legally permissible.
Collection
Arrange collection from our Sandton facility by prior arrangement.
The replacement part itself will be supplied in accordance with the applicable warranty.
Where applicable South African law requires Black Root Global to bear a particular cost associated with a statutory warranty remedy, that legal requirement will take precedence.
The Consumer Protection Act provides statutory remedies for qualifying defective goods, including circumstances where goods may be returned at the supplier's risk and expense within the statutory warranty period.
26. NON-WARRANTY REPLACEMENT PARTS
Where a replacement part is required for a reason that falls outside the warranty, the part may be supplied at Black Root Global's cost price, subject to availability.
This may include parts required due to:
- human error;
- misuse;
- accidental damage;
- incorrect operation;
- improper maintenance;
- unauthorised modification;
- normal wear and tear; or
- other circumstances outside the warranty.
The applicable part cost will be communicated before the order is placed.
Any applicable transportation or local delivery charges will be communicated separately.
27. WARRANTY PART TIMEFRAMES
Warranty replacement parts may need to be sourced internationally and therefore may not be immediately available in South Africa.
Where a part must be imported, the timeframe may be affected by:
- supplier availability;
- international shipping;
- air or sea freight schedules;
- customs;
- port processing;
- public holidays;
- import requirements; and
- other logistics circumstances.
Any timeframe provided for a warranty replacement part is an estimate and not a guaranteed delivery date.
Black Root Global will make reasonable efforts to keep the customer informed regarding the status of the replacement part.
28. SERVICING & ON-SITE TRAINING
Black Root Global does not provide routine servicing or on-site training for this machine.
The machine is supplied with a comprehensive instruction manual intended to assist customers with:

Where applicable, video instructions may also be provided to assist with setup, operation and basic troubleshooting.
Customers are expected to operate the machine in accordance with the supplied instructions.

- the manufacturer's instructions;
- supplied documentation;
- applicable safety requirements; and
- applicable workplace or operating requirements.

Black Root Global may use third parties, including:

- customs agents;
- logistics providers;
- payment providers; and
- courier companies
to fulfil orders.
Where a third-party provider causes a delay or problem, Black Root Global will make reasonable efforts to investigate and assist with resolving the matter.
The use of a third-party service provider does not remove any legal responsibility that Black Root Global has to the customer.

Black Root Global will not be responsible for delays caused by circumstances outside our reasonable control to the extent permitted by applicable law.
These circumstances may include:
- customs delays;

- supplier disruptions;
- courier disruptions; or
- other unforeseen events.
Where such circumstances occur, we will make reasonable efforts to minimise their impact and provide customers with available information.
33. CONSUMER RIGHTS & STATUTORY WARRANTIES
Nothing in these Terms is intended to:
- exclude a right that cannot legally be excluded;
- prevent a customer from exercising a statutory right;
- waive a mandatory consumer protection;
- misrepresent the customer's legal rights; or
- limit a remedy that the law requires us to provide.
The Consumer Protection Act provides an implied warranty of quality for qualifying goods and specific remedies where goods fail to meet the applicable statutory requirements. This statutory protection operates alongside an express warranty.
Where a mandatory provision of South African law conflicts with these Terms, the applicable law will prevail.
34. LIMITATION OF LIABILITY
To the extent permitted by law, Black Root Global will not be responsible for indirect or consequential losses arising from circumstances outside our reasonable control.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by South African law.
Nothing in these Terms limits statutory consumer rights or remedies that cannot legally be limited.
